Ownership & Rights
Chad Jones Photography, Inc. reserves the right to re-license, transfer, or resell the images without notice or compensation.
License for Real Estate & Leasing Projects Only
All photographs created by Chad Jones Photography, Inc. are owned by Chad Jones Photography, Inc. Copyright is never transferred. Clients are granted a limited, non-exclusive, non-transferable license strictly for marketing the specific property under contract. Use includes MLS listings, websites, social media, digital marketing, print brochures, and self-promotion after the close of escrow. All rights not explicitly granted in this Agreement are reserved to Chad Jones Photography, Inc.
License for Any Other Use
All photographs created by Chad Jones Photography, Inc. are owned by Chad Jones Photography, Inc. Copyright is never transferred. Please refer to your contract/quote or estimate for your agreed-upon specific terms. All rights not explicitly granted in this Agreement are reserved to Chad Jones Photography, Inc.
Additional Usage
If the Client wishes to make any additional uses of the Work (including new uses, promotional uses beyond the listing, resale, rentals, redevelopments, or transfer to a third party, excluding self promotion), the Client agrees to seek permission from the Photographer and pay additional licensing fees as determined at that time.
Client is under no circumstances permitted to sell or collect payment of any kind for the use or display of Licensed Content produced by Chad Jones Photography, Inc.
Chad Jones Photography, Inc. reserves the right to re-license, transfer, or resell the images without notice or compensation.
Alteration
The Client may not alter, edit, manipulate, or add material to the images without the Photographer’s prior written permission. Alterations include but are not limited to AI editing, AI video creation, illustrations, photographs, computerized effects, text, or sound.
AI Editing Policy and Disclosure
Chad Jones Photography may use artificial intelligence (AI) tools to assist in limited aspects of post-production editing, including but not limited to image enhancement, sky replacement, object removal, or perspective correction. These tools are used solely to improve image quality and efficiency while maintaining the artistic integrity and professional standards of the final work.
All AI-assisted edits are performed under the creative direction and supervision of Chad Jones Photography. However, due to the evolving nature of AI technology, results may vary and may contain unintended artifacts or inaccuracies.
Chad Jones Photography is not liable for any perceived or actual errors, omissions, or discrepancies resulting from AI-assisted editing or processing.
Requests for AI-generated or AI-modified content that may misrepresent a property, individual, or scene—or that violate ethical or legal standards—will be declined at the sole discretion of the photographer. Chad Jones Photography reserves the right to refuse any AI-related request without explanation if it is deemed inappropriate, misleading, or outside the intended scope of service.
All deliverables created using AI tools remain subject to the same licensing, usage rights, and limitations outlined in the Terms of Service.
Loss, Theft, or Damage
Ownership of all Work remains with Chad Jones Photography, Inc.
The Client assumes full responsibility and strict liability for any loss, theft, or damage to the Work while in their possession.
No unedited files will be provided.
Once the files are delivered, the photographer’s responsibility ends.
No photo archive is maintained.
Releases
The Client agrees to indemnify and hold harmless the Photographer from any and all claims, costs, and expenses—including attorney’s fees—that arise from unauthorized use, uses exceeding a granted release, or alterations made without permission.
The language in this Agreement will be interpreted as to its fair meaning and not strictly for or against any party. If any portion of this Agreement is deemed to be illegal or unenforceable, the remaining provisions of this Agreement remain in full force.
