Agreement Introduction and Definitions
This Agreement, along with any applicable documents referenced herein (collectively, the “Agreement”), constitutes a legal agreement between Chad Jones Photography, Inc. (“Photographer,” “we,” “us,” or “our”) and you, the client (“Client,” “you,” or “your”). By accessing our website, booking a session, purchasing photography, video, or related media services (collectively, the “Media”), or otherwise engaging with our services, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions of this Agreement.
These terms govern all work performed by Chad Jones Photography, Inc., including the creation, delivery, licensing, and use of photographic, video, drone, and related media content. Your use of our services or acceptance of delivered media signifies your full acceptance of these terms.
We are an independent contractor and not your employee. You are not our agent and cannot make agreements for us.
Definitions
Photographer / Photography Team / We / Us / Our
Refers to Chad Jones Photography, Inc., a California-based photography and media corporation, including its owner, contractors, and representatives.Client / You / Your
Refers to the individual, company, or entity entering into this Agreement and commissioning media services from Chad Jones Photography, Inc.Media
Refers to all creative works and deliverables produced by Chad Jones Photography, Inc., including but not limited to photography, video, drone imagery, floor plans, 3D tours, virtual staging, websites, social media content, and all other visual or digital media.Agreement / Contract
Refers to this legally binding document and all associated invoices, quotes, proposals, or signed communications between Chad Jones Photography, Inc. and the Client that reference these terms.License
Refers to the limited, non-transferable rights granted to the Client to use the Media as outlined within this Agreement or on associated invoices.
Property Readiness & On-Site Conduct
Properties must be fully prepared for photography prior to my arrival. No pets or persons other than the agent should be present during photography or videography. If the property is not ready, I reserve the right to cancel or reschedule, which may incur a $75 rescheduling fee or a $150 on-site disruption fee if work must continue around pets, people, or cleaning.
Creative Direction & Approvals
The property is photographed as-is unless otherwise arranged in advance. Creative direction is based on the photographer’s professional discretion unless specific requests are made prior to the shoot.
Cancellation and Rescheduling
It is mutually understood that if a cancellation is due to circumstances beyond our control, such as a power outage, an unfortunate incident, or weather conditions, we will reschedule the appointment without any additional fees or discounts. Otherwise, cancellations made less than 24 hours before the scheduled appointment may incur a cancellation fee.
Revisions and Adjustments
The Client MAY NOT alter, edit, use AI, manipulate, or add material to the images without the Photographer’s prior written permission. Alterations include but are not limited to adding illustrations, photographs, computerized effects, AI editing, text, or sound.
Minor revisions to photos may be requested within five (5) business days of delivery.
Video projects include one (1) round of revisions. Additional rounds are $150 each.
Music changes require a full recut and will be billed at $150.
Revisions requested after final delivery are subject to additional charges.
No unedited files will be provided. Once the files are delivered, the photographer’s responsibility ends.
No photo archive is maintained.
License for Real Estate & Leasing Projects Only
All photographs created by Chad Jones Photography, Inc. are owned by Chad Jones Photography, Inc. Copyright is never transferred. Clients are granted a limited, non-exclusive, non-transferable license strictly for marketing the specific property under contract. Use includes MLS listings, websites, social media, digital marketing, print brochures, and self-promotion after the close of escrow. All rights not explicitly granted in this Agreement are reserved to Chad Jones Photography, Inc.
License for Any Other Use
All video & photographs created by Chad Jones Photography, Inc. are owned by Chad Jones Photography, Inc. Copyright is never transferred. Please refer to your contract/quote or estimate for your agreed-upon specific terms. All rights not explicitly granted in this Agreement are reserved to Chad Jones Photography, Inc.
Additional Usage
If the Client wishes to make any additional uses of the Work (including new uses, promotional uses beyond the listing, resale, rentals, redevelopments, or transfer to a third party), the Client agrees to seek permission from the Photographer and pay additional licensing fees as determined at that time.
Client is under no circumstances permitted to sell or collect payment of any kind for the use or display of Licensed Content produced by Chad Jones Photography, Inc.
Chad Jones Photography, Inc. reserves the right to re-license, transfer, or resell the images without notice or compensation.
AI Editing Policy and Use Disclosure
Chad Jones Photography may use artificial intelligence (AI) tools to assist in limited aspects of post-production editing, including but not limited to image enhancement, sky replacement, object removal, or perspective correction. These tools are used solely to improve image quality and efficiency while maintaining the artistic integrity and professional standards of the final work.
All AI-assisted edits are performed under the creative direction and supervision of Chad Jones Photography. However, due to the evolving nature of AI technology, results may vary and may contain unintended artifacts or inaccuracies.
Chad Jones Photography is not liable for any perceived or actual errors, omissions, or discrepancies resulting from AI-assisted editing or processing.
Requests for AI-generated or AI-modified content that may misrepresent a property, individual, or scene—or that violate ethical or legal standards—will be declined at the photographer’s sole discretion. Chad Jones Photography reserves the right to refuse any AI-related request without explanation if it is deemed inappropriate, misleading, or outside the intended scope of service.
All deliverables created using AI tools remain subject to the same licensing, usage rights, and limitations outlined in the Terms of Service.
Harassment Policy
Clients must provide a safe and respectful working environment. Any form of harassment, threats, violence, or unsafe conditions will result in immediate cancellation of services without refund.
No Refunds and Adjustments Policy
All sales are final once services are rendered and/or digital assets have been delivered. Downloading, publishing, or otherwise utilizing any of the media constitutes full acceptance of the work and licensing terms. Hiring another photographer or subjective dissatisfaction does not constitute grounds for a refund.
Payment Terms
Please make your payment within 15 days of the invoice date. Payments not received within this period will incur a 10% late fee. After 30 days of non-payment, I reserve the right to revoke the use of any photographs provided and seek legal means to reclaim any fees unpaid. All Sales Are Final.
Limitations of Liability and Damages
The Client assumes full responsibility and strict liability for any loss, theft, downloading or uploading of any material or documents, or their use of any application or functionality associated with the site or service, or damage to the Work while in their possession.
Indemnification
The Client agrees to indemnify and hold harmless the Photographer from all claims, costs, and expenses—including attorney’s fees—that arise from unauthorized use, uses exceeding a granted release, or alterations made without permission.
The language in this Agreement will be interpreted as to its fair meaning and not strictly for or against any party. If any portion of this Agreement is deemed to be illegal or unenforceable, the remaining provisions of this Agreement remain in full force.
